The legislators in both chambers of the legislator of Wisconsin approved a draft law on Wednesday that gig driver for transit apps formally classified as an independent contractor and not as an employee.
The legislation states that drivers for transit apps such as Lyft and Uber or for delivery services such as Doordash or Instacart are not direct employees of these companies that they have excluded from the preservation of the compensation of the employee, the minimum wage requirements or the entitlement to unemployment insurance.
The legislation, which is supported by large technology companies such as Uber, Doordash and Instacart, was supported by almost all Republicans and a handful of Democrats. Those who voted for this argued that the classification of independent contractors gives employees the freedom to determine their own hours and to drive several companies without restrictions.
It is rejected by the AFL-CIO union and most Democrats, which argued that gig workers should often remove these jobs out of the need and are entitled to certain basic standards, such as a minimum wage.
The invoice also determines “portable services” for such employees who would enable authorized drivers to pay accounts that would then help to cover paid vacation, retirement, health care or catastrophic events.
MPs Alex Dallman, R-Maresan, who said he used to drive for Uber, the legislation would make sure that GIG workers “can choose when and where they want to work, what freedom that they need to be able to achieve advantages for these different companies in order to really set up things and health insurance for a future of success.
Dallman said on Wednesday that Wisconsin's proposal would make the country's first state to classify Wisconsin the first state in the country.
After years of the nationwide debate about how GIG workers can be classified, this is also at the federal level under the Ministry of Labor of the former President Joe Biden. The bidet management had proposed a rule to classify these employees as employees who were entitled to the advantages of full-time employees.
During his first government, President Donald Trump made a rule from the previous Trump government, which described the same workers independent contractors.
The assembly passed the law on Wednesday with a vote of 56-36, with four Democrats voting for the plan with the Republicans. The Senate said goodbye with 17-15 coordination with a Republican, Senator Steve Nass from Whitewater, and joined all Democrats to vote against it.
A spokesman for governor Tony Evers did not respond to questions if he wanted to sign the law.
