Skye Mathieson is a partner in the Government Contracts Group in Crowell & Moring's Washington, DC office. He works with clients across a variety of industries and advises them on a variety of matters, including contract performance disputes (CDA claims and reasonable adjustments), cost eligibility issues, incorrect pricing, tax issues, prime-sub disputes, bid protests, internal investigations, and responding to DCAA Audits. Prior to joining Crowell & Moring, Skye spent several years as a litigator in the Air Force Legal Operations Headquarters Acquisition Litigation Department, where he pioneered the groundbreaking “Laguna “Defense”, which is now being addressed and negotiated on a large scale before the contract appeal boards.
Skye has extensive experience litigating cases before the Armed Services Board of Contract Appeals (ASBCA), the Civilian Board of Contract Appeals (CBCA), the Government Accountability Office (GAO), and the Small Business Administration (SBA). Through this litigation, Skye has gained valuable experience in a variety of industries, including aerospace (fighter aircraft, satellites, tankers, simulators and countermeasures), information technology and software development, construction, healthcare services, intelligence gathering, battlefield services and logistics, scrap disposal, maintenance and base repair contracts and many others.
Skye also has experience advising and litigating a wide range of legal issues, including mispricing, cost denials, contract terminations, individual merchandise issues, design changes, differing site conditions, statute of limitations issues, CDA jurisdiction hurdles, contract fraud and the Government superior knowledge, unabsorbed overhead and Eichleay Compensation, CICA stays and waivers, and small business issues.
Having represented and litigated on behalf of both the government and contractors, Skye has unique insights into the perspectives of both parties, which he uses when considering and negotiating settlements or other alternative dispute resolution (ADR) options. Where agreement is not possible, Skye takes advantage of advocacy opportunities in court. He has extensive trial experience examining experts and experts in direct examination and cross-examination, as well as taking and defending depositions, drafting hearing briefs and motions for disposition, and managing the production of millions of pages of documents.
Skye is an active member of the government contracting community. He is editor-in-chief of the BCA Bar Journala quarterly publication of the Boards of Contract Appeals Bar Association, allowing it to collaborate with judges, prosecutors and in-house counsel in the preparation of each issue. He is also a member of the ABA Section on Public Contract Law.
