The U.S. Ministry of Labor issues new guidelines to ensure that the farmers in the regulations of the H-2A workers ensure clarity

The Labor Department finds that Glenburn contractor ignored repeated warnings and a site-specific safety plan in fatal trench collapse at the Brownville construction site

WASHINGTON -The wage and hourly department of the US Ministry of Labor announced today that it will release the enforcement of the stressful rule for the farm workers 2024 of the bidges by the bidges. The decision offers the urgently needed clarity for American farmers who navigate the H-2A program, and at the same time corresponds to the continuing commitment of President Trump to strictly enforce the US immigration laws.

Since several federal court connections have created considerable legal uncertainties, inconsistency and operational challenges for the legal employees of H-2A workers, this bulletin for Feld Aid makes it clear that the department will not immediately enforce the final regulation of 2024.

The implementation of the rule had already been suspended by the department based on federal investments. This guideline does not change existing regulations or does not limit the authority of the wage and hourly department to enforce the H-2A requirements defined before the final rule in 2024. It replaces all the opposite or contradictory instructions for field personnel, but does not create any legally enforceable obligations or do not change any legal or official requirements to ensure the complete enforcement of the US immigration laws.

For additional instructions that go beyond the Bulletin of Field Assistance, employees and employers can contact the wage and hourly department under the free Helpline 866-4US (487-9243).
